1. Acceptance of Terms
By creating an account or accessing Gather ("the Service"), operated by Shortcut (Toma El Atajo SAPI de CV), you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of a company or other legal entity, you represent that you have the authority to bind such entity.
2. Description of Service
Gather is a cloud-based resource scheduling, project capacity forecasting, and margin tracking application designed for creative, design, and engineering organizations.
3. User Accounts and Authentication
You must authenticate using a supported OAuth provider (e.g., Google OAuth). You are responsible for maintaining the security of your account and credentials. You agree to immediately notify Gather of any unauthorized use of your workspace.
4. Intellectual Property & Customer Data
You retain all right, title, and interest in and to any data, project plans, rate configurations, and materials you upload or enter into Gather ("Customer Data"). Gather claims no ownership over your Customer Data.
5. Subscriptions and Billing
Gather offers paid per-seat subscription plans processed securely via Stripe. Fees are billed in advance on a recurring monthly or annual basis. You may upgrade, downgrade, or cancel your subscription at any time through the in-app billing portal.
6. Limitation of Liability
To the maximum extent permitted by applicable law, in no event shall Shortcut (Toma El Atajo SAPI de CV) be liable for any indirect, incidental, special, consequential, or punitive damages resulting from your use of or inability to use the Service.
